1. General

  1. Please read these Terms of Use before using a Lawcover website or portal.
  2. These Terms of Use govern access to and use of this and other websites and/or portals owned and maintained by Lawcover Insurance Pty Limited (“Lawcover”, “we”, “us” or “our”).
  3. Use of a Lawcover website and/or portal (each a “Website”) indicates your acceptance of these Terms of Use.
  4. We may amend these Terms of Use from time to time and, when we do, we will publish the latest version on our Website. You agree to review and be bound by the current Terms of Use when using a Website.

2. Disclaimer

  1. Website content is provided “as is”, without any express or implied warranty or guarantee that the content or software is accurate, complete, adequate, timely, uninterrupted, non-infringing, virus-free or error-free, or any warranty or guarantee of any other kind.
  2. Website content does not, under any circumstances, constitute legal, insurance, risk management or other professional advice.  Users should consider seeking professional advice before relying on any Website content.

3. Use of a Website

  1. In order to access some of the functionality of a Website, including to register for a course, seek an insurance quote, accept and pay for your insurance, make a purchase or complete an online course, you may need to input your email address and create a password, or otherwise set up an account. You may need to include your law practice number issued by the Law Society if prompted to do so.
  2. In using a Website, you agree:
    1. to be bound by these Terms of Use;
    2. to provide us with accurate and complete information and updates when using a Website, including making a purchase or inquiry or renewing your insurance;
    3. that you are solely responsible for the use of your email address and/or password and/or account details in accessing a Website and you will keep all passwords secure;
    4. that access to a Website via your email address and/or account details is deemed to be use of the Website by you for the purposes of these Terms of Use;
    5. to notify us immediately of any unauthorised use of a Website, your Website account details or any other breach of security.
  3. In using a Website, you agree that you will not:
    1. do anything in breach of any applicable laws, regulations, codes and standards;
    2. provide or upload false or misleading information, create a false identify or use or attempt to use another person’s account;
    3. hack into any part of a Website through password mining, phishing or any other means;
    4. knowingly introduce a virus, Trojan, worm, logic bomb, spyware, malware or other similar material;
    5. circumvent a Website’s structure, presentation or function to obtain information that we have not made publicly available through a Website;
    6. act in any manner that negatively impacts other Website users, including through a denial-of-service attack or a distributed denial-of-service attack;
    7. transmit any unsolicited advertising, promotional materials, or other materials that contain any solicitation with respect to products and services other than those made available by us via a Website, unless authorised by us; and
    8. attempt to modify, reverse engineer or reverse-assemble any part of a Website.

4. Intellectual Property

  1. Copyright in this Website is owned by Lawcover, or others who have licensed their material to Lawcover, and all rights are reserved. The Lawcover trademark is owned by Lawcover.
  2. Other than as expressly authorised by Lawcover or as permitted under the Copyright Act 1968 (Cth), you may not sell, modify, copy, distribute, transmit, display, reproduce, republish, licence, frame, upload, transmit, post, communicate or use Website content, or the layout or design of a Website.
  3. Legal practices insured with Lawcover may take appropriate use of Website content within their legal practice.
  4. You warrant that any material you post to a Website does not infringe a third party’s intellectual property right, is not obscene, and is not defamatory or threatening in any way.
  5. You agree that Lawcover has full rights to use any material you post to a Website, subject to Lawcover’s Privacy Policy.

5. Privacy

  1. We may collect Personal Information (as that term is defined in the Privacy Act 1988 (Cth)) via a Website. Any Personal Information collected via the Website will be handled in accordance with our Privacy Policy.

  1. We may use cookies to provide our products and services to you via this Website. Cookies are text files stored on your computer so that when you visit a web page your IP address and the name of the website you visited is recorded.  The next time you visit the same website, the text file communicates that you have been there before, and content may be personalised or tailored.
  2. You can enable or disable cookies by adjusting your browser options. Other than necessary cookies, which enable the Website (for example, registration or purchase process), you can reject the placement of all cookies or delete cookies that have been placed already.

Lawcover is not liable to you or any third party for any damage, losses (including consequential loss and loss of profit), costs or expenses (including reasonable legal fees) or liability of any kind incurred by a person in connection with the use of or inability to use the Website, or in connection with these Terms of Use.

9. Indemnity

You agree to indemnify and hold harmless Lawcover, its employees, contractors, agents, suppliers and officers from and against any damage, losses (including consequential loss and loss of profit), costs or expenses (including reasonable legal fees) or liabilities of any kind arising in connection with your breach of these Terms of Use, the violation or breach of any laws (including any act of fraud by or on behalf of you) or the infringement of the rights of any third party.

10. General

  1. These Terms of Use are governed by and construed in accordance with the laws and jurisdiction of New South Wales.
  2. The terms and conditions of this agreement are severable and if any part of these terms and conditions is held to be invalid or unenforceable, that provision may be removed but will not affect the enforceability of the remaining provisions.
  3. Our failure to act with respect to a breach of these terms and conditions by you or others does not waive our right to act on subsequent breaches.
